NESHAP Direct Final Rule

A direct final rule correcting the lead-acid battery manufacturing National Emission Standard for Hazardous Air Pollutants ("NESHAP") rule was published in the Federal Register on March 26th. See attached. As you will recall, one aspect of the July 2007 rule caused us some concern, and BCI thus had sought review of the NESHAP rule in the D.C. Circuit Court of Appeals. Our concern was that state regulators would interpret the new rule to require manufacturing plants to demonstrate compliance with regulations other than the NSPS. The direct final rule responds to our suit by revising the rule to clarify that such an interpretation is incorrect.

The March 26th rule also fixes an incorrect cross reference and moves out from September 15, 2008 to March 13, 2009 the deadline for submitting notification of compliance reports. EPA moved the notice of compliance deadline to make it after the January 12, 2009 stack testing deadline that applies to facilities without prior representative stack tests.
